Court Of Appeal Strips A Woman Off Ksh 11 Million Compensation

Court of Appeal stripped off a woman Ksh 11 million compensation awarded by a Resident Magistrate’s court.

Pelezia Salim was involved in an accident on March 7, 2012, and filed a case against the Somoire Keen of J Keen Transporters and Somon Transporters.

Somoire Keen is the son of the late politician, John Keen. The companies were asked to pay for the damages, and the Resident Magistrate Christabel Agutu granted Pelezia Ksh 11 million as compensation.

However, Somoire and the defendants appealed the case and the High Court reversed the judgment of the magistrate and granted Pelezia only 2 million Ksh for damages.

High Court stated that the magistrate’s court awarded a compensation fee beyond its jurisdiction as it is only limited to a fee of Ksh 2 million.

Pelezia filed a suit at the Court of Appeal seeking to overturn the decision of the High Court, arguing that the judge based his ruling on technicalities.

Appellate Court Judges Daniel Masinga, Patrick Kiage and Martha Koome, instead, upheld the ruling of the High Court.
