The Independent Electoral and Boundaries Commission (IEBC) has gazetted former Samburu Senator Sammy Prisa Leshore to replace Nominated Senator Isaac Mwaura.
This is despite an interim court order issued on Tuesday evening against his removal.
The Milimani High Court had ordered that the respondents refrain from implementing or acting further on the Political Parties Tribunal’s decision pending the hearing and determination of the motion.
“I am also convinced that there is need to grant interim orders. Consequently, the motion dated May 11, 2021 is fixed for interpartes hearing on May 24, 2021,” Justice Joseph Sergon said.
Mwaura has been embroiled in a protracted battle with the Jubilee party, which resulted in his expulsion.
Jubilee Secretary General Raphael Tuju announced on February 8, that the National Management Committee (NMC) had met and deliberated on a report filed by the party’s disciplinary committee.
“The NMC in exercising its mandate provided under article 7 (2a) of the party’s constitution and relying on other enabling provisions of the party law has expelled the following senators, ” the statement read.
Those expelled include nominated Senators: Isaac Mwaura, Seneta Mary Yiane, Waqo Naomi Jilo, Omanga Millicent, Prengei Victor, Iman Dekow and Gona Christine Zawadi.
