Laid Off Workers In Kisii University Threaten To Sue The Institution.

Employees facing retrenchment at Kisii University have now vowed to move to court to challenge their termination if the university does not withdraw the redundancy notice.

In a letter to the university through their lawyer, the over 200 staffers argue that they were not consulted by the institution before the notice was issued.

Lawyer Danstan Omari told the university from the letters of redundancy, it is apparent that the services of the employees have not been rendered superfluous.

The lawyer said the university had stated the growth of the institution had not been commensurate with the available resources and that revenue from fees paid by privately sponsored students had declined.

“There is no valid and legitimate reason to effect redundancy of the 350 employees as you have clearly indicated that you intend to outsource the same functions to an outsourcing agency, which prima facie demonstrates that there is work to be performed by the current holders of the said positions,” part of the letter read.

The staffers argue the redundancy is fundamentally flawed as the institution failed to give any prior warning, which is a violation of an employee’s right to be heard under Article 50 of the Constitution.

“Our instructions are to demand from you, which we hereby do, that you withdraw the said notice of redundancy issued in the letters with 12 hours as the same is unprocedural, unlawful and substantially unfair,” said lawyer Danstan.

He said failure to withdraw the notice, he will institute legal proceedings on behalf of his clients against the university.
