Nelson Havi, the Chairman of the Lawyers Society Of Kenya (LSK) has come out stating that the Parliament should be dissolved within 21 days of which failure to do so will mean that the president will be in direct violation of the constitution.

Nelson Havi speaking to a press conference today stated, “The President is duty-bound to dissolve Parliament…the court has interpreted reasonable time as not exceeding 21 days. The President will be in violation of the Constitution should he fail to dissolve Parliament on/before October 12, 2020.”

According to Havi, this will give back authority to Kenyans as should be. He also called out to any judge to whom the petition will be placed to rule on reminding them that its their oath to uphold the constitution.

“The consequence (of not dissolving Parliament) is that any legislative authority exercised by Parliament thereafter will be without the authority of the people of Kenya. Any judge before whom the petition is brought must uphold the Constitution” Nelson Havi stated.
