Former finance CS Henry Rotich is in trouble as the prosecution is ready to produce at least 52 witnesses to testify against him in a multi-billion Arror and Kimwarer dams scandal.

The only issue at hand now will be the time allocation for all the witnesses considering their large number.

The defence has however urged the court to ask the prosecution reveal what they unearthed on their alleged trip to India regarding the case, terming it critical the DCI and DPP reveal their findings.

“We want the investigative report from the Italian insurance company called Sace,” lawyer Katwa Kigen said.

The defence insisted that it should be made clear as to which witnesses set to testify against their client would be relevant to the case against Rotich.

Trial magistrate Douglas Ogoti however maintained that no evidence will be locked out, adding that order must be adhered to.

The prosecution denied allegations that the DPP went to Italy to investigate saying that the DPP doesn’t engage in investigation as his work is to prosecute.

The prosecution submitted that they do not need to go to Italy to get information from Sace, a company allegedly involved with Rotich, as they have offices in Upper Hill, Nairobi.

The court will issue directions on how matters will be carried out on April 23, 2021.
