The fate of the MPs is now in the hands of the president and CJ Maraga after six petitions landed in Maraga’s desk seeking dissolution of parliament over the flopped Gender Bill.

The Gender bill is a constitutional requirement that requisites not more than two-third of  the members of elective or appointive positions be of the same gender. It has collapsed four times on the National Assembly floor.

One of the petitions was tabled by LSK president, Nelson Havi who said the parliament violated the 2010 constitution by failing to implement the gender bill.

“Article 261 (7) provides that if parliament fails to implement any court-ordered legislation to implement the constitution , the chief Justice will advice the president to dissolve parliament,” said Havi.

Fredrick Mbugua, Margret Toili, Bernard Aoko, Stephen Owoko and former Marakwet West MP, David Sudi are the other petitioners.

It is said currently 78% of the MPs are male which is against the constitutional requirement of two-thirds or 67%.
