A couple has been saved from losing Ksh1 billion property, including a luxury mansion in Muthaiga, Nairobi, two high-end vehicles, three pieces of land, and Ksh10.5 million in bank accounts.

The Court of Appeal held on to the Government’s plan to seize property belonging to Joseph Wanjohi and Jane Wambui.

In February 2020, Justice Mumbi Ngugi ordered the Assets and Recovery Agency to recover property after the couple was accused of drug and wildlife trafficking.

“We know the damage crime of narcotic drugs has brought on families and devastation caused the trade in wildlife trophies. We can’t overemphasize on determent of such illegal trade. We must ensure they don’t enjoy the proceeds of such crimes,” she stated.

In their appeal, the two argued that they had explained their source of income, and the court refused to acknowledge their statement.

Appellate Judges argued that Mumbi based her decision on false claims made by the investigating officer without evidence that the property were proceeds of the crime.
