Malimwengu! A man in western murders brother over witchcraft claims

A man in Busia County has been jailed for killing his brother in 2017 for allegedly using juju in killing people and causing accidents in the village.

Mr. Samwel Pamba was found guilty on December 11, 2019 by Justice Kiarie Waweru of the High Court in Busia town.

“From the evidence on record, I am satisfied that the prosecution has proved the offence of murder against the accused. I find him guilty and accordingly convict him for the offence of murder contrary to section 204 of the Penal Code,” ruled Justice Kiarie.

Wilfred Egesa of Munando village in Bukhayo West location, Busia County was murdered on the 31st of May 2017 by his brother Pamba who has been charged with the murder.

Pamba and two other men constantly accused Wilfred of witchcraft within the village. The prosecution said that they timed Wilfred, attacked and fatally injured him on the said date.

In his court defence, Pamba said he found his brother lying in a pool of blood wounded. He denied any involvement!

“At one point, my husband asked me to eavesdrop and listen to what his brother and friends were saying.” Said Jeniffer Nekesa, the deceased wife.

She testified that she stood at her door, and heard Pamba and Kizito Mangenyi and a nephew named Bossy insulting her late husband and accused him of killing many people through witchcraft. They also insisted that he used black art to cause accident and was the main suspected in killing a man named Lawrence Wanjala.

“In their discussion, they promised to kill Wilfred and I persuaded them to talk it over the following day which they agreed.” Said Nekesa

Later when Nekesa and her husband where in the house, Kizito called the deceased out and told him that he had a message for him. When he went out, she testified that she heard Kizito tell him that his brother Pamba had asked him to inform him (Wilfred) to stop witchcraft.

Wilfred asked his brother how he knew he practiced witchcraft. Within no minute, she heard the sound of something being hit and went out. She found him sprawled on the ground with blood oozing from his head.

The accused, Kizito and Bossy were each armed with a club and were beating up her husband. She raised an alarm. Kizito and Bossy ran away while the accused remained at the scene.
