Watchman Compensated Only Ksh1000 After Battling For Five Years In Court

Daniel Mwanzau, who worked as a security guard since 2001, filed a case with a Labour Court after he was fired for showing up to work drunk.

He went to court seeking Ksh714,000 after unfair dismissal in 2015 but received Ksh1,000 as compensation.

Mwanzau wanted the company to pay him Ksh494,000, apart from Ksh114,000 damages, in compensation for unpaid overtime during the 13 years he worked for the company.

He wanted to be paid Ksh14,500, which he claimed was unpaid salary.

Mwanzau told the court that he did not show up to work drunk as claimed by the company. He said that no test had been done to confirm the claim.

He added that the company had sent him a warning letter due to misconduct and admitted that he had written an apology letter to the company, stating that he would not repeat the offense.

Human Resource Manager of the security company said that Mwanzau fled a number of times and showed up to work while drunk and did not deserve any compensation, considering that his dismissal was justified.

Justice Onesmus Makau stated that the petitioner should be compensated for his uniform.

Mwanzau had also not cleared with the company, and that cost him Ksh1,380, leaving him with only Ksh1,020.
