High Court Issues Directive On Closure Of Schools

On Thursday, 19 November, the High Court ruled that it was unconstitutional for President Uhuru Kenyatta to order school closure in March of this year following the outbreak of the Covid-19 pandemic.

Justice James Makau claimed that the order was a breach of the right of children to education.

The judge directed all school children to begin face to face learning no further than 60 days from November 19, 2020.

The court also found that it was inappropriate for Education CS George Magoha to make decisions without the intervention of the National Education Board and the respective County Education Boards. The judge stated that it was a violation of the Basic Education Act.

The court went on to ban community-based schooling terming it as unlawful.

Since then, the Ministry of Education has issued the school calendar in preparation for the resumption of learning on Monday, 4 January 2021.
