In a ruling by High Court Judge Mumbi Ngugi on Monday, 21 September, Rose Musanda was ordered to forfeit her six cars, including her Toyota Axio saloon car, to the Assets Recovery Agency (ARA) after she had been linked to drug trafficking.

The judge ruled that the evidence before the court confirmed that the property had been acquired through illegal means.

“It is my finding that the applicant, the Assets Recovery Agency has concluded, on the balance of probability, that the motor vehicles and the funds covered by this application are proceeds of crime, and that they should be forfeited by the State,” she ruled.

She also revealed that Musanda had not shown a credible source of her wealth.

In addition, Justice Ngugi ordered her to surrender a total of Ksh1.7 million to ARA in two accounts, one holding Ksh1.462.963 and the other holding Ksh325.712.

In her defense, however, Musanda said that she had raised the money by selling her plot in Kakamega County.

She added that she had inherited Ksh 500,000 from her late husband with a boost to her income in the matatu and second-hand clothing business.
